Tender for private security services: investigation on possible agreements between the main market operators

In its meeting of February 21st, 2018, the Italian Competition Authority launched a preliminary investigation on the following companies: Coopservice s.coop.p.a., Allsystem S.p.A., Istituti di Vigilanza Riuniti S.p..A. and its parent companies SKIBS S.r.l. and Biks Group S.p.A., Italpol Vigilanza S.r.l. and its parent company MC Holding S.r.l. , Sicuritalia S.p.A. and its parent company Lomafin SGH S.p.A., in order to ascertain whether these Companies have concluded one or more agreements, in violation of art. 2 of Law n. 287/90 and/or art. 101 of the TFUE.
In particular, on the occasion of certain public tender procedures for the assignment of private security services, these companies would have adopted mode of participation aimed to avoid the competitive comparison in tender, also by means of the unjustified use of the Raggruppamento Temporaneo di Imprese (Temporary Enterprises Grouping) (RTI) institute.
The investigation regards the tenders announced by the following companies: ARCA Lombardia in 2016, by Trenord in 2014, Expo 2015 in 2013, Intercent-ER in 2013 and 2015 and by Infrastrutture Lombarde in 2013, but it does not exclude that this supposed concertation may be more extensive.
This proceedings was launched also on the basis of the reports received by the National Anti-corruption Authority, on Trenord and on the associations ANIVP and ASSIV.
Today the Antitrust Officials have carried out down raids at the involved Companies premises, with the assistance help of the Antitrust Special Unit of the Guardia di Finanza.
This proceedings will be concluded by May 31st, 2019.
