GORIZIANE/FIAT FERROVIARIA (Start of full phase investigation)

The Italian Competition Authority decided to initiate an investigation against Fiat Ferroviaria, a company belonging to the Fiat Group and engaged in railway constructions.

The proceedings originated from a complaint filed with the Authority by the Goriziane company which was unable to take part in a contract bidding conducted by a public agency managing local railways for the general overhaul of Fiat/Iveco manufactured diesel engines for the 300- model traction units.

Fiat Ferroviaria in fact prevented Goriziane from responding to the agency invitation to tender by refusing to supply original spare parts to it.
Goriziane was discriminated by this refusal to supply given that the tender notice provided the obligation on the awarding party to use original spare parts, otherwise the contract would have been cancelled.

The contract bidding was awarded by Fiat Ferroviaria which was the only one bidder being able to make a proposal in line with the tender notice requirements.
