The Antitrust Authority has begun investigations into an alleged abuse of dominant position by Ferrovie dello Stato


The Antitrust Authority has resolved to institute an investigation into the Ferrovie dello Stato company to ascertain whether it has abused its dominant position, in violation of Section 3 of the Antitrust Act, on the intermodal transport market.

The intermodal transport market is for the haulage of goods over long distances, normally using containers. The organization of intermodal transport typically uses several forms of transport (by sea, road and rail), coordinating them and managing the distribution and collection points.

The investigation began as a result of complaints from the Cesare Fremura S.r.l. company and Associazione Assologistica, alleging that the system of tariffs, rebates and penalties which Ferrovie dello Stato applied to intermodal container transport operators for its rail freight services favoured the Italcontainer company, which was a subsidiary of Ferrovie dello Stato, operating in the combined transport market, to the detriment of its competitors.
This discriminatory practice was alleged to be intended to exploit the dominant position of Ferrovie dello Stato on the rail freight market to enable it to expand its activities to take in the combined transport services market.

The investigation is scheduled to be completed by 21 October 1999.
