Commencement of proceedings against Telepiù for exceeding the
60% ceiling on sports broadcasting rights
At the session held on 24 June 1999, the Authority resolved to commence proceedings against Telepiù under Section 2(1) of the Law 78/99. On the same day, Telepiù notified the Authority that it had acquired exclusive encoded broadcasting rights for the 11 teams taking part in the serie A football championship for the 1999-2000 season.
The 60% ceiling on exclusive encoded broadcasting rights, pursuant to Section 2(1) of the Law, must be calculated in reference to the number of serie A football championship matches, or at all events the number of matches in the most important tournament or championship taking place or being organized in Italy. Telepiù has exceeded that ceiling because the total number of matches in the serie A football championship for which the company has acquired exclusive encoded broadcasting rights has reached 61.1% of the total scheduled matches.
The proceedings are intended to ascertain whether the conditions obtain for an exemption to be made to the statutory ceiling, and must be completed within 60 days.
