Investigation of the dry docks in the port of Naples


On 24 May 2000, the Competition Authority resolved to commence investigations into the Camed company and its subsidiary company, Bacini Napoletani, to ascertain whether an abuse of dominant position had been committed against section 3 of the Competition Act on the market for the provision of dry dock facilities in the port of Naples. These dry docks have been awarded under government franchise to Bacini Napoletani and are used to provide services for the repair of ships' hulls.
The conduct complained of is, firstly, that obstacles had been placed in the way of shiprepair and maintenance companies in the port of Naples by failing to submit, or delaying the submission of, their quotations for the use of the dry docks, lack of transparency regarding their availability, and raising objections on unspecified technical and safety grounds.
Secondly, in the contractual relations between Bacini Napoletani and Camed, it is alleged that the financial conditions were substantially different from those imposed by the Bacini Napoletani company on other shiprepair companies, thereby placing them at a competitive disadvantage without justification.
The investigation will be completed by the end of April 2002.
