The Competition Authority has begun a fresh investigation into ENEL/Infostrada
At its meeting on 24 October 2002, the Competition Authority resolved to begin an investigation into the ENEL, France Telecom and Wind Telecomunicazioni companies regarding the Wind Telecomunicazioni/Infostrada merger.
This operation had been the subject of a previous measure adopted by the Competition Authority (which cleared it subject to certain conditions) and it had also been cleared by the administrative court, at first and second instance.
This fresh investigation was deemed necessary, in particular, following and in compliance with the judgment handed down by the Council of State (Supreme Administrative Court) on 1 October, which ruled that the measures imposed by the Competition Authority were illegitimate because they were not proportionate, and requested the Authority to re-examine the whole operation.
The investigation will end by 8 December 2002
