FS – RFI: ANTITRUST AUTHORITY, NO ABUSIVE CONDUCT FOUND FOR TRAVEL FACILITY ACCESS. COMMITMENTS ACCEPTED FOR MAINTENANCE AREA ACCESS


An investigation into possible abuses of dominant position has come to a conclusion.

On October 22nd, 2009, Autorità Garante della Concorrenza e del Mercato handed down two distinct rulings as it concluded investigatory proceedings concerning Fs and Rfi (Italian Railway Network), which were purported to be engaging in abusive conduct by blocking their competitors' access to railway infrastructures. The Antitrust Authority found insufficient evidence to substantiate the existence of obstacles allegedly created by Fs and Rfi to block access to travel facilities. The investigation concerning access to maintenance infrastructures, on the other hand, was closed upon the Antitrust Authority's acceptance of commitments proposed by Rfi. In specific, Ntv (the company's competitor) was granted access to the "Fascio Traccia Alto" area next to the central train station in Naples, and the company also agreed to ensure that any subjects seeking access to the maintenance infrastructures will be treated fairly and equally on the basis of objective, cost-oriented criteria. Regardless of the fact that Ntv has decided to build its own maintenance center at the Nola Interport, the Antitrust Authority found Fs and Rfi's willingness to make the "Fascio Traccia Alto" area available to their competitors sufficient to alleviate the problems that led their competitors to request investigatory proceedings.
