SOCCER LEAGUE: ANTITRUST AUTHORITY ACCEPTS COMMITMENTS, ONE NEW PACKAGE FOR SERIES A AND THREE NEW PACKAGES FOR SERIES B
The League has also promised, beginning with the 2012-2013 Championship, to incorporate Antitrust Authority recommendations for new soccer season guidelines.
A new package of series A television rights and a three-part Platinum Live package for Series B - these were the measures that the Antitrust Authority accepted and made binding after the European Commission and the Antitrust Authority returned positive evaluations of the Soccer League's proposals for broadcasting rights. This concluded the proceeding begun on July 22nd, 2009, to investigate possible abuses of dominant position by the League in its centralized marketing of broadcasting rights.
The investigation initially focused on the assignment of television rights for Series A games in the 2010-2011 and 2011-2012 seasons, but on October 01st, 2009, it was broadened to include assignment procedures for Series B rights, as well.
As for Series A, the Soccer League committed to offering a package deal (in addition to those previously identified and already assigned) designated specifically for the satellite platform. It will include pay-based transmission rights for broadcasting the highlights of all Series A Championship events. The highlights may last a maximum of 10 minutes per broadcast and may be transmitted immediately after the matches are over.
For Series B, the League has committed to subdividing the satellite platform's Platinum package into three independent packages to be assigned through competitive bidding, which shall be concluded by February 26th, 2010. The first package includes home and away games for 12 teams, the second consists of home and away games for the 10 remaining teams and the third consists of matches played in advance or that were postponed, which will be transmitted in collaboration with the holders of the first two packages. The recipients of packages A and B may also re-broadcast recorded versions of highlights for the games in their own respective package as well as games from other packages. The League has also decided to eliminate the preferred economic terms and conditions offered to recipients of Series A rights in the past.
For the 2012-2013 Championship, furthermore, these updated guidelines will be replaced by new guidelines after receiving pre-approval from the Antitrust Authority with respect to competition-related concerns and package formulation: the League has already committed to incorporating the Antitrust Authority's recommendations.
According to the Antitrust Authority, the commitments proposed by the Soccer League are sufficient to foment lively competition in the TV rights acquisition phase and to stimulate competition in the pay-TV market, both between different platforms (satellite and digital) and within individual platforms. They also ensure observance of Antitrust Authority recommendations beginning with the next round of guidelines.
