TELEPHONY: ANTITRUST ACCEPTS TELECOM COMMITMENTS. THE DATA SET AND SERVICES SHARED WITH COMPETITORS WILL BE EXPANDED TO ENABLE THEM TO PARTICIPATE IN TENDERS ON EQUAL TERMS

Investigation into possible abuse of dominant position closes without establishing a violation.


In a meeting on 19th June 2012, the Autorità Garante della Concorrenza e del Mercato decided to accept the commitments presented by Telecom Italia within the context of an investigation into a possible abuse of dominant position designed to obstruct the participation of competitors in tenders for telephony services. The Antitrust, which closed the proceedings without establishing a violation, judged the measures presented by the company to be fitting to overcome the competitive issues that had initially been contested. The commitments, which the Authority made binding for as long as Telecom holds a dominant position in the wholesale access markets, expand the data set and services that are made available to Telecom's competitors (i.e. OLO, Other Licenced Operators) to enable them to formulate their own bids for the tenders fielded by large public and private customers and to supply various new guarantees in the field of internal-external equality of treatment.

According to the Antitrust, the commitments proposed by Telecom complete the set of information being made available to the OLOs and provide new tools for the preparation of tender bids.

Telecom has been granted three months to inform the Authority of the measures being taken to honor these commitments.
