ALITALIA-CAI: ANTITRUST TAKES NOTE OF THE EIGHT SLOTS FREED UP ON THE MILAN-LINATE STOP AND MANDATES NEXIA INTERNATIONAL AS THE MONITORING TRUSTEE TO INITIATE THE PROCEDURES FOR THEIR TRANSFER

Number suitable for effective removal of the company's monopoly position. The subjects to be awarded the slots must be identified by 28th October.

 

The Autorità Garante della Concorrenza e del Mercato, during its meeting on 27th September 2012, took note of Alitalia-CAI's willingness to release eight slots (some in the morning, some in the evening) on the Milan Linate stop. According to the Antitrust, the extent of the company's measure is sufficient to effectively eliminate its monopoly position on the Rome-Milan Linate route.

The Authority also approved Alitalia-CAI's decision to entrust Nexia International with a mandate as monitoring trustee, since this company is qualified, independent and privy of conflicts of interest with the company. Nexia, as a result, will be in charge of the procedure for evaluating other carriers' requests for these slots and awarding the slots. To do this, the company will gather carrier requests, which must include the commitment to operate the Milan Linate-Rome route for at least six consecutive IATA seasons, starting with the Winter 2012/2013 season, and identify, by 28th October 2012, the carrier(s) best suited to provide the most effective and efficient competitive constraint on air transport services for the route in question.

According to the Antitrust's indications, the monitoring trustee will take into consideration the priority conditions of financial soundness, full corporate and commercial independence from Alitalia-CAI, the total number of slots requested and the goodness of the specially drafted business plans.

The Authority, lastly, has taken note that Alitalia intends to indicate the specific time slots to be released. In this regard, the Authority has found that the monitoring trustee, if no company is found to be capable of competing effectively with Alitalia on the basis of the time slots it proposes, shall draw upon all of the factors at its disposal and consult with the Authority in order to identify the time slots to release that are best suited to guarantee the development of an effective competitive constraint.

Nexia International shall provide the Authority with regular progress reports on this procedure.
