PRIVATE HEALTHCARE: ANTITRUST LAUNCHES AN INVESTIGATION TO VERIFY THE EXISTENCE OF A POSSIBLE AGREEMENT AMONG FOUR COMPANIES OPERATING IN THE ABRUZZO REGION
Synergo S.r.l., Casa di Cura Privata Villa Serena (with Leonardo Petruzzi S.r.l. as sole shareholder), Casa di Cura Privata Di Lorenzo S.p.A. and Presidio Ospedaliero Villa Letizia might have adopted a joint strategy to bid in tenders for the responsibility of clinics that are already part of the Angelini group
In its meeting held on 06th November 2013, the Autorità Garante della Concorrenza e del Mercato decided to launch an investigation to determine whether four companies operating in the private healthcare sector in Abruzzo have in place an agreement that restricted competition.
Proceedings, initiated in the light of a report by the company Seagull, should verify the possible existence of a common strategy between the companies Synergo S.r.l., Casa di Cura Privata Villa Serena (with Leonardo Petruzzi S.r.l. as sole shareholder), Casa di Cura Privata Di Lorenzo S.p.A. and Presidio Ospedaliero Villa Letizia regarding participation in the tender to entrust responsibility for clinics that are already part of the Angelini group. In particular: in the first tender (concerning Santa Maria clinic) only Di Lorenzo (through its subsidiary Villa Gaia) participated; in the second tender (concerning Sanatrix clinic) only Villa Letizia took part; Synergo, Villa Serena and Di Lorenzo jointly participated in the tender for the clinic Villa Pini in which Villa Letizia did not take part. According to allegations that were made at the start of the proceedings, the decision to participate jointly in this last tender was only adopted by the three companies when, in the face of a final and irrevocable offer of purchase that was submitted formally by Seagull, it appeared certain that their failure to participate would have led to the award of Villa Pini to the competitor.
Proceedings will be completed by 31st December 2014.
