INVESTIGATION BY THE ANTITRUST AUTHORITY ON THE PUBLIC OFFER TO BUY AND EXCHANGE (OPAS) INVOLVING EI TOWERS AND RAI WAY
The Competition and Market Guarantor Authority has resolved to launch an investigation, pursuant to article 16(4) of Law No. 287/90, in respect of the concentration transaction consisting in the public offer of purchase and exchange (OPAS), put forward on 24 February by the EI Towers S.p.A company and concerning all the shares of the Rai Way S.p.A. company.
The investigation by the Antitrust Authority aims at ascertaining the possible creation or consolidation of a dominant position in the market of television and radio broadcasting infrastructures. Given the “vertically integrated” nature of the Mediaset Group, to which EI Towers belongs, the investigation further aims at ascertaining the possible effects on competition in the different source markets in which the Group is present, in particular, among them, those relating to digital TV broadcasting and to TV adverts.
The investigation must be concluded within 45 days, without however derogating from the contemplated deadline for the Communications Authority to issue its opinion.
