TEMPORARY SUSPENSION OF THE OFFER “ALL INCLUSIVE MAXI” PROVIDED BY WIND TELECOMUNICAZIONI

On the basis of the information acquired and consumers’ complaints, and in particular filed by Aduc, the ICA ordered the temporary suspension of the additional telephone service “All Inclusive Maxi” and related charges provided by Wind Telecomunicazioni to customers that did not express their “explicit activation consent”. According to the ICA’s opinion, Wind was binding customers to a new offer that entailed additional costs as to what agreed upon in the main contract, without “previously” asking for their consent and thus obliging them to take measures to terminate the service. The ICA also kept into consideration the high level of offensiveness of the conduct, on the basis of the amount of users involved (more than one million).

Within seven days Wind Telecomunicazioni must communicate to the ICA the implementation of the Authority’s decision, providing a detailed report illustrating the measures adopted. In case of non-compliance, the ICA can fine the company for an amount ranging from 10,000 Euros to 5 million Euros.
