Preliminary investigation launched for alleged collusion in the tenders called by SORESA for healthcare waste collection and management services in Campania region

In its meeting on 27 September 2017, the Italian Competition Authority (“ICA”) resolved to initiate preliminary investigation proceedings for possible anti-competitive conduct, in violation of TFEU Art. 101, carried out by the companies Langella S.r.l., Ecologica Sud S.r.l., Bifolco &Co. S.r.l., Ecosumma S.r.l. and Eco Transfer S.r.l. on the occasion of their participation in the first call for tender announced by SO.RE.SA. (Società Regionale per la Sanità S.p.A.) for the collection and initial disposal service of hazardous and non-hazardous medical waste from the local healthcare companies of the Campania Region.

The companies involved, each of them being contracted for the said service in the past, allegedly concluded an agreement between them aimed at restricting competition for the allocation of the lots put out to tender. Indeed, they competed for different lots of the SO.RE.SA. tender, without overlapping, and their technical offers shared the same format.

The proceedings was initiated based on SO.RE.SA.’s report and must be completed by 31 October 2018.

The proceedings initiation decision has been notified today during inspections carried out by the ICA in collaboration with the Special Antitrust Unit of Guardia di Finanza.
