Non-requested activation with debit in personal account, precautionary measure for Switch Power
PRESS RELEASE
The Italian Competition Authority deliberated the adoption of a precautionary provision ex parte towards Switch Power S.r.l for aggressive practices consisting in the non-requested activation of power supply contracts, based on false and seriously deceptive information concerning the identity of the professional and the content of the offer, and using personal consumer data and the subsequent debit of 130 euro on the consumer’s personal bank account.
The suspended practices of Switch Power regard:
- the conclusion of distance contracts and activation of power supplies (outbound teleselling procedure), in the absence of a corresponding manifestation of the will of the consumer, as a result of deceptive information, informative omissions and undue conditioning;
- the activity directed to activate debit and recharge costs - equal to 130 euro - on the consumer’s accounts for the non-requested supply, until the contract is validly concluded, with the improper use of the consumer’s IBAN, a few days after the recording of the telephone call.
Switch Power must communicate the occurred performance of that which is stated in the suspension precautionary measure to the Italian Competition Authority within 5 days of its reception, sending a detailed report in which the adopted measures are shown.
