PS11368 - ICA: 3 new proceedings opened against buy & share schemes

New enforcement actions have been brought by the Authority against buy and share schemes: one proceedings has been initiated for assessing the buy&share scheme  set up by Oobs S.r.l.s. (website: shoppati.it ), whereas two proceedings have been launched against the Girada S.r.l.s. (website: girada.it ) and Zuami S.r.l.s. (website: zuami.it ) for failing to comply with decree no. 27636 (PS10842B) and decree no. 27637 (PS11175) of 10 April 2019, which had already sanctioned the professionals for their buy&share schemes.

In particular, the conducts under investigation concern a commercial offer for products at particularly discounted prices which does not ensure the actual purchase of the product, but a mere reservation: in fact, to purchase the product, the consumer must wait for other consumers to make a similar "purchase". Furthermore, products are assigned and delivered to consumers in an extremely random way, as the reservation list scrolling mechanisms are not known and nor are the waiting times.

The Authority also disputes the failure to recognise the right of withdrawal and the failure to reimburse the amount originally paid.

During these proceedings, the Authority was once again supported by the Special Antitrust Unit of the Italian Finance Police.
