PS12727 - Italian Competition Authority: Fine of €40,000 against Saglietti S.r.l. for credit card surcharge

The company imposed an extra charge on purchases completed with a credit/debit card or PayPal on the raptor4x4.it website.
The activity of the Italian Competition Authority in the fight against credit card surcharge continues. The Authority imposed a fine of €40,000 on Saglietti S.r.l., active in the online sale of accessories, machine tools and special parts for cars, for having imposed on consumers a price surcharge directly related to the use of the chosen payment method (so-called surcharge), in breach of Article 62(1) of the Consumer Code.
The Authority found that the company applied price surcharges of €3 for credit/debit card payments and €8 for PayPal payments in relation to purchases made on the raptor4x4.it website.
The Authority recalls that the regulation applied in these proceedings aims to protect consumers' contractual rights and, in conjunction with other legal measures prohibiting the imposition of surcharges, strives to fulfil the European Union's objective of creating a unified payment system free from discrimination among financial instruments.
