The proceeding has been initiated against seven companies active in vehicle maintenance and repair. The tenders issued by Ama concern maintenance services on Iveco, Mercedes and Renault branded chassis cabs and mechanical units.

The Competition Authority has opened an investigation against seven companies active in vehicle maintenance and repair (Autofficina F.lli Pennesi - Società in nome collettivo, MFM S.r.l., Autofficina Pontina S.r.l., Drive Line Service S.p.A., Italmeccanica S.r.l., Pagliani Service S.r.l., Raggruppamento Officine Meccaniche AR.MA. S.r.l.).

The proceeding arose on the back of a report submitted by Ama S.p.A. surrounding possible anti-competitive conducts by the participants in the three procedures launched between March and May 2023 for the award of maintenance services on Iveco, Renault and Mercedes branded chassis cabs and mechanical units. In particular, the methods of participation showed a lack of competition in all three procedures and unsatisfactory outcomes for the contracting authority. Critical issues also continued in the tender procedure launched by Ama in December 2023, following the revocation of the first three competitive procedures. The seven companies may therefore have violated Article 2 of Law No. 287/1990.

Yesterday, the Authority's officials conducted inspections at the premises of the companies and other entities deemed to be in possession of useful information for the preliminary investigation, with the help of the Special Antitrust Unit of the Italian Financial Police (Guardia di Finanza).
